Burkham, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Texas County, Case No. CRF-74-41, for the offense of Knowingly Concealing Stolen Property, After Former Conviction of a Felony. His punishment was fixed at three (3) years in the State Penitentiary, and from said judgment and sentence a timely appeal has been perfected to this Court.
